Blows me away this guy still has a following. This property owner will likely never allow anyone on his place again because of this tool. He should also be denied a booth at the expo. I hope they get a full conviction. The only video I ever watched of his was him hunting antelope and he shot a smaller buck in a group and was pissed cause he wanted the bigger of the bunch and blamed his buddies. The guy is total scum of the earth.

He has a following because the masses who want to watch mule deer hunts simply search YouTube for mule deer hunts. Since their account is Muley Freak and they have videos killing mule deer they appear in the top search results. The masses are none the wiser about him being a poacher because that is not within the search parameters.

In my eyes, walking on private land without permission is trespassing. Posted or not.

You dont own the land beneath your feet, and no one gave you permission to be there.

In today's world, there is zero excuse for trespassing other than being an ignorant prick.
There are a myriad of situations where "trespassing" is not a moral issue in the western U.S. Where you live it's probably different. Out here, we have miles of unposted open spaces that are owned my huge corporate ranches, railroads, etc... surrounded by public land. Some of it is way up in the high mountains. Poaching on someone's 100 acre ranch is not the same as walking through a piece of corporate land, which isn't being used nor occupied, to access public. I think there's a much more important moral issue with land ownership with us selling farm land to China, not some dude shed hunting on an ambiguous piece of corporate property. I'm actually in favor of taking away corporate ranch land and giving it back to the public. Some of these companies own "too much" land out west. That's my opinion though. Slippery slope and all that, but some of these welfare ranchers shouldn't own as much as they do. Eminent domain that shit back to us. Our gov't can just print money to pay them for it.

If the case that is linked below means anything, I would say that he doesn't have a lot to be worried about. Pretty sad.

Honestly poachers have a huge incentive to do what they do and take the risks when the punishments are this lenient. And this is one of the “big” cases. 23 years?!!!

You serious Clark? I'm sure there's someone out there somewhere who thinks you have too much of something. You cool with them taking that away from you like you want land taken away from people you don't like?

If it's a mainland Chinese company that owns it tell them it's for the collective good or some other communist crap. I'm sure they'll be fine with it then.

Sounds to me like you have to prove you didn't know.
In the US justice system the burden of proof is always on the government to prove the positive and absolutely never on the defendant to prove a negative.
Proving negatives can be literally impossible to do.

All fun and games until someone thinks you have too much. Easy take others stuff, but when they run out of stuff and they take yours it becomes a problem then I guess. All Hail Chairman Mao.

Not all large ranches are foreign owned and yes trespassing out West is an issue too. We take it very seriously.

In this situation, all the " justice system " has to prove is you were on someone else's property and it was posted according to the law. He was and it was. The law says that it has to be posted on the corners and all right of ways. IF he were to claim he entered from another way and didn't see the posting, then he will have to prove his alibi. Forget about the part where the owner TOLD him not to hunt there. As for the Felony charge, possession of a trophy animal taken illegally is all that is needed. He showed consciousness of guilt by trying to return it. Also the "burden of proof" can be circumstantial evidence as well as direct and eyewitness evidence.

Seriously? Trespassing is big deal, don't care who owns the land - if it aint your's or public - stay off.

It would be nice if "they" were required to provide access to the landlocked BLM and other public land. Would be a big game changer for sure.

In the case of typical criminal justice, as in person on person crime, correct. However, F&W laws, they are Prima Facia laws. As such, it does not work quite the same. You can think of Prima Facia laws just like tax law, and when the IRS sends you a bill; to not pay the IRS, when their evidence shows you owe money, you need to provide evidence of the contrary. In short, guilt is presumed without contrary evidence. This is why a Warden does not need a warrent to search you or your vehicle if you appear to be or have been hunting or fushing.

Agreed on the China issue, not on the other. My issue is land being purchased in "checkerboard" fashion which land locks tons of public land and access.

What if it's not a Chinese company? An Itialin company owns 1% of all the farmland in NC...Last time I checked they were pushing 60k acres...

I did watch it. He says he had permission. Has pictures with the landowner and the landowner is related to one of his employees.
Sounds kind of fishy.
