Nevada you can hunt land that isn't posted even if private. I'm all for throwing the book at him given his history, but I don't think trespassing in the deserts of UT, ID, NV should be enforced at all if not amply posted with signage. I shed hunt on private all around Reno cuz it's not posted. People recreate all over private in NV. If it's not posted, just because ONX exists, doesn't mean we have to know where the boundaries are. That's 100% on the landowner.
I am really conflicted by this stance on private property. It seems like a very entitled way of thinking. Similar to guys who think just because they grew up hunting a particular piece of property have the right to continue to do so if it changes ownership.

A felon can’t own or use a firearm. Not sure the laws on black powder, crossbows or compound bows. Maybe he could spear them
Convicted felonys can use archery and blackpowder if they don't get their rights back after the fact. Basically anything that doesn't required a 4473.

I have read on Facebook that he’s really a good guy and the truth WILL come out and set him free. He just got caught up in another conspiracy to dethrone yet another legit instafamous poacher, I mean hunter…

They change the law a couple years ago. Now it's up to you to know.

Not true, it still says that in order for a trespass to occur, property must be posted at all access points in a way that a reasonable person would recognize it as private land, unless of course said property is cultivated farmland or associated with a residence

Does ANYONE here think that Erik doesn't know what trespassing is? And good luck proving that you didn't know you were trespassing in court because you walked "around" and didn't see the paint or signs. The only way would be if you had a GPS to show where you walked. And then you should have known it was private.

Glad to see Idaho has a felony statute (we have one in Montana too- very, very hard fought to get it!!), many states don't.

Real teeth with a felony.
Idaho also has a mandatory license suspension with trespassing while hunting. Minimum of one year, up to 3 years. That's before the felony charge is taken up. He's already made half a dozen or so court appearances on the misdemeanor charges. The March 28th court date is for the felony charge.

Old news, finally getting some press. Trial was moved to later this month. When asked at the utah show he said he crossed private to recover a Deer; per the guy that asked him. Seems he would have just called the landowner if that was the case.
He's a liar. I've read the police report. Part of this landowner's property was unfenced and bordered BLM, he had permission to use that unfenced section to access the BLM. He was specifically told he could NOT hunt any of the fenced section of the property. He shot the buck that the landowner was saving for his grandson inside of the fenced section, that they had name and picked out after running trail cameras all summer. The part he had permission to cross was almost a mile from where he shot the buck. Eyewitness saw him shoot the deer as well. He can try to spin it however he wants but the report lays out a pretty strong case against him. Including offering to pay the landowner not to press charges, and returning the rack and meat.

In Montana (and likely elsewhere) there is a very distinct difference between criminal trespass and hunting without landowner permission. For criminal trespass it requires posting OR the landowner (or his agent) saying you can't be there. For hunting without permission there is no posting or verbal notification needed- if you're hunting on someone's deeded w/o permission you can be cited.

Makes you wonder how many times he hasn’t been caught. If the info above about being a mile away from where he was supposed to be is true, as bad as this already was, that adds a whole new dimension of just how bad this is. Hope they throw the book.
