Going to preface this again that I do want things to permanently improve on the borders.
I believe it was a stretch for folks on this site to imply that it is an impossibility for a court to get involved when it comes to military land. Despite what these same individuals claimed courts did get involved on the military base in Hawaii, intervened on behalf of protected butterflies on an artillery range (think it was PA), and the Marines killing protected tortoises (will give this one a pass as it was vague on where they did the killing - on the initial base lands or the extension land).
All it takes is for one person to be arrested for trespassing (doesn't even have to an illegal) to get a lawyer, file a lawsuit in a "friendly" district, and claim that the military doesn't have authority to do so under the Posse Comitatus Act. They don't have to ultimately win the case to be successful. The way things are going, I would not be surprised in a member of Congress did "oversight" work by storming the NDA and forcing the issue.
