I'm not sure. Without a survey no one really knows exactly where the corner is anyway. If LOs would just let people climb the fence at the post, it would be a non-issue.

I don't know if the five foot rule is an ADA thing or a nod to OHV access but it will certainly be a sticking point.

I do like the idea of legislating that it is legal to cross from one corner to the next using the currently visible lines of occupation.

There are easement rules for fences in many places, too.

I think climbing fences is a major liability issue. What happens if you damage the landowners fence? What happens if a poorly erected fence fails while trying to climb and you get injured?
I have a 6’ fence. Should I have to have it 5’ from the corner just in case someone buys property kitty corner and wants to cross from one of their pieces to the other? Completely laughable.

If two private LOs share a corner one can't restrict the other from accessing their property. Should be the same for private/public corners IMHO. The public "owns" the land so why should one owner have more rights than the other? I understand how it all started, but enough is enough, change the damn laws and allow the public to access and use "their" land. 5' setback isn't needed.

Honestly, it’s all steeped in landowners who simply don’t want you accessing that sweet plot of land they have locked up back there behind their property. It’s selfish and ridiculous and not a single one of ya advocating for landowners being able to prevent people from god forbid step over your land from one piece of public to another piece of public have an honest argument. I own land, it doesn’t bother me one bit if someone’s foot touches it for half a second as theyre passing through. Y’all are an embarrassement to landowners, such a tired argument.

Agreed, I own 240 acres with (gasp) an easement for the neighbor to access his land behind mine.

The outrage! Funny thing is when the neighbors land changed hands, the new owner asked if they could install cattle gates, and haul a few loads of white rock to help keep one of our big hills from washing when it rains! So the easement has made my life easier with a better road and not having to open gates all the time!

I think a 5ft allowance would suffice without baring fences there, but I'm guessing this stems from the Elk mountain guys putting signs right on the corner and saying they could build tall fences right at the corners.

Yes , taking that 5 ft is taking private land. Not allowing a LO to fence his ensore property is in essence taking that part of their land.
Walking over the corner is fine.
No, constitutionally speaking, a taking is a permanent physical invasion of the land or a total diminution of its value. This is basically a zoning restriction, which is not a taking under the law.

Would be interesting to pull an "enemy of my enemy is my friend" scenario here with the large outdoor non-hunting population in CO by educating them more openly on how much public land is blocked. Obviously OnX and others have put this information out there, but could be an interesting partnership to align on (public access to public lands)

Lol give me a break dude. Zoning restrictions are in place everywhere. I have one in my back alley for the dump truck. The fence is 5’ from a single spot: the corner.

Why would you be in favor of a 5' setback in this instance and what purpose would it serve in your opinion? Setbacks have a great purpose in residential areas. Those make sense to most of us. In the middle of wide open ranch space they would only have one purpose to me... vehicle access. Do we really want that in every nook and cranny of our public lands? I personally do not.
I’m not saying I’m inherently for a 5’ setback. I’m saying that it’s ridiculous to act like a 5’ setback is stealing land from the landowners currently locking up public land.

As the bill sponsor, I will tell you the impetus for writing this bill was to protect private landowners, and to help them with trespassing charges against those that do ill will on their property. The bill was also to protect the public to be able to access public lands that have been given to all of us. This bill is a great bill, one that could bridge the gap between private property ownership and public land access. I have had multiple stakeholder meetings and I’m going to post pone the bill so that we can get more input from the community. that’s what a good legislator does. I didn’t see this Facebook group coming to my defense to help prevent Covid vaccine mandates for minors or to protect women in athletics by banning biological males from participating in girl sports. Where was the public testimony from this group to help protect women in sports or the unnecessary harmful effects of the Covid vaccine in our children? I have a servants heart, and I’m doing the best to represent the Constituent base that voted me into office. I am not reaching across the aisle because the Democrats don’t want anything good to come out of Colorado. They just banned property owners from being able to shoot on their own property so if you don’t think that they’re going to build trails through corner, crossing or take it or make it mandatory, you guys are sadly mistaken. I was trying to get in front of the large bus headed for private property owners rights. Next time call me and I’ll let you know what the bills intent was.  and just to clarify, if you happen to read the bill, it said, in the very first section that you were not able or allowed to stop on private property.

True that. People like to think sections just fit as neatly on the surface of the earth as they look on onx. Not so! To find a corner reliably you either need a monument to be present or a couple thousand dollar gps reciever.

The ADA access portion gives future leverage when the bill is killed; "so and so voted against equal rights for those with disabilities".

I can support the Bill but not quite a fan of the 5ft dimension.

If you’re going to apply ADA, openings only need to be 36” wide as a standard wheelchair is 32”.

So there must be another factor for the 5’ dimension

Sometimes you add a few things to a bill that seem a little outlandish so that in the process of debating the bill you can remove those things in order to come to a "compromise".
