I'm not sure. Without a survey no one really knows exactly where the corner is anyway. If LOs would just let people climb the fence at the post, it would be a non-issue.

I think climbing fences is a major liability issue. What happens if you damage the landowners fence? What happens if a poorly erected fence fails while trying to climb and you get injured?
Agreed, I own 240 acres with (gasp) an easement for the neighbor to access his land behind mine.Honestly, it’s all steeped in landowners who simply don’t want you accessing that sweet plot of land they have locked up back there behind their property. It’s selfish and ridiculous and not a single one of ya advocating for landowners being able to prevent people from god forbid step over your land from one piece of public to another piece of public have an honest argument. I own land, it doesn’t bother me one bit if someone’s foot touches it for half a second as theyre passing through. Y’all are an embarrassement to landowners, such a tired argument.
No, constitutionally speaking, a taking is a permanent physical invasion of the land or a total diminution of its value. This is basically a zoning restriction, which is not a taking under the law.Yes , taking that 5 ft is taking private land. Not allowing a LO to fence his ensore property is in essence taking that part of their land.

I’m not saying I’m inherently for a 5’ setback. I’m saying that it’s ridiculous to act like a 5’ setback is stealing land from the landowners currently locking up public land.Why would you be in favor of a 5' setback in this instance and what purpose would it serve in your opinion? Setbacks have a great purpose in residential areas. Those make sense to most of us. In the middle of wide open ranch space they would only have one purpose to me... vehicle access. Do we really want that in every nook and cranny of our public lands? I personally do not.
