While the Supreme Court should be non-partisan, it is not. If we only had Supreme Court Justices that went by the Constitution then it would be viewed as a highly conservative Court. Ignoring the Constitution and legislating from the bench is a tell-tale sign of a liberal justice. With that said, I don't agree that Reagan shouldn't had appointed Scalia. He was a great Supreme Court Justice who did his sworn duty in that role.....unlike many of the others.

Well said! It is tiresome to hear how most of the time he was just a radical conservative, simply because he was honestly and evenly applying the Constitution to the cases that came before him. I would love to see the liberal judges learn something from him and follow the Constitution as well, indepedendent of their own ideologies.

If they truly believed in, supported, and defended the Constitution, they wouldn't be a liberal.

I love the way Obama now states that he will fulfill his Constitutional obligation by nominating a new Justice. Why start being Constitutional now? He's ignored it the last 7 years. But I do agree, he should nominate a candidate. But I also agree that Congress should not confirm any candidate that doesn't fully agree with, support, or be willing to defend the Constitution. That will immediately rule out any and all nominees from Obama.

IF we had a Majority leader with any balls or at least a sliver of conservative thought we would not have to worry about this until 2017. With McConnell and the rest of the establishment I fully expect them to confirm a leftist Obama appointee and claim they had no other option.
