For those wondering it will be the hunters responsibility to know where they are and where the corner is to cross, yes most LOs do know where their corners are.
Many are marked but hard to find, I know one that the corner marker is a piece of wire stickling out of the ground.
When you read the ruling it is based on the fact they did not touch the private land, be careful crossing and don't touch the private.
The UIA addresses the fences at the corners restricting access.
They do have to come up with an approved manner of corner crossing - might even have to paint the monuments and corner pins to increase visibility.Of course it’s the hunters responsibility to know where they are.
With that said, it’s my understand that it was always assumed in the interpretation of the law that corner crossing violated the air space of the private property. That’s a very low burden of proof for the state. Basically if it was observed you hopped a corner, guilty.
Now the state has to prove that you ACTUALLY touched the private property. Much higher burden of proof that frankly I don’t see the states having the resources to fight in any meaningful way.
Best course of action for hunters in my humble opinion:
1.) Run a track.
2.) Take a picture of the corner.
3.) Be respectful to LEO but don’t share any information beyond “I’m hunting legally, officer. I was on public at all times. Here’s my license. Any other questions about my supposed whereabouts should be directed to my council.”
4.) Share your evidence with your attorney.
All you’ll do is talk yourself into a ticket sharing anything more.

Anyway, it is one step closer to allowing access to the public. Made possible by GPS and OnX.
If they come up with an "approved manner" to corner cross, then there would be some consistency in how it is done and not leaving all kinds of folks to figure things out on the fly. It would remove inconsistencies and keep people from making judgement calls that lead to problems.Do they really have to do that?
Not touching private land is not touching private land. This is still a free country the last time I checked, you don’t need extra special permission to not break the law.
I can’t imagine you’d find many juries willing to convict someone that ran a track, took a picture of the corner, and was respectful to law enforcement while they were obeying the law. Be a good neighbor and you’ll be fine. Do stupid stuff and you’ll probably win stupid prizes.

Rancher or GW has cell/game cameras set up at corners to monitor folks? If you say you crossed and he doesn't have photos on the cell/game cam???
Nothing wrong with your track/breadcrumbs. What's the accuracy of the GPS track on your cell phone or handheld? 3 meters? I'm not sure if can certify to 3 feet on handhelds and cell phones, but what do I know (we have surveyor quality GPS's at work). If it is 8-10 feet, then someone can say you didn't cross at corner and all you have is good intentions and wasted money on an attorney.
So you got Johnny going out where he's never been at 04:00 cause he wants to cross 2 corner before daylight. He's got OnX but can't find the monument cause there is no fence, so he just crosses wrong location figuring he's "close enough". Don't forget that other hunters will do stuff to mess folks up as quickly as land owners - it's not all on the landowners when the guy before you puts a pile of grass on top of the monument to keep competing hunters away.
Just need to give it a little more time and allow for some acceptance and consistency in the process. We're almostthere.
Thats exactly what this ruling says they cannot do. If they do, turn them in.I also foresee ranchers installing fences 20 ft or so tall near the corners. Gonna be hard to bring a ladder in to cross that!
No way, it is illegal to pull corner markers and they know this. I'm not foreseeing $750 fines being handed out right and left. There will be trail cameras at every corner that matters. Just wait and see.
Also, I foresee landowners pulling monuments out of the ground as fast as they can find them.

Not all LO are jerks.
