I don't care who filled the suit. I can tell you if my company was spending six figures on advertising and the magazine was telling me it reached X amount of readers when they knew it only reached Y, that's fraud. Not only could this become a major financial issue, someone could be looking at jail time if they knowingly let this happen year after year. Burden of proof is on KUIU - Eastman's will have to show the number of subscribers, names will be left out and mailing address.

And for all the keyboard legal experts, Jason runs a $50mil company and built another couple million dollar company. He sure as shit ain't stupid. He knew this would create a PR cluster. With that in mind, I have to think his attorneys are pretty confident in their position.

For Kuiu to have $50m in rev year after year they would have to avg 62,500 customers spending $800 a year. If talking Sitka his partner seems to have been the one in control since he sold his majority stake and pretty much ran Jason off.

Interesting, wonder how accurate the sales figures are since it isn't a public company and can't be verified but here is the $50m prediction this year for Kuiu. Looks like Kuiu had around 20k customers last year and broke even in 2013. Access Denied

Interesting in this article he expects they write 40-50k thank you note (so 50,000 customers spending $1000ea to get $50 million) but he took out a SBA loan last year, not sure why he would do that and only owns 70% of the company. He later met with more than a dozen banks, all of whom denied him because of, as Hairston puts it, Kuiu’s lack of an accounts receivable division. Eventually, a bank owner with whom he had a family relationship finally gave him the green light for an SBA loan last year. As a result, Kuiu doesn’t have a board of directors or advisors. Hairston says he still owns 70 percent of the company’s equity.

“It’s all those little things that we do that has built this company into something special without a lot of money,” Hairston says. “It’s powerful. It’s cheap. But it’s a lot of work.”

“Because we’re the hot, cool, underground brand, people want to be associated with that,” Hairston said.

Funny commentary from people I'm guessing have never been sued. And it's the "well they wouldn't sue of they couldn't prove it" mentality that is one crappy side effect of being sued. Maybe that's what the goal is. Make people think you must be right because you're suing. Maybe they have a case. All I know is i have seen malicious lawsuits damage reputations.

That is very true, also legal costs to defend have bankrupt many people.

Yeah he said it in an interview in the Bloomberg link above that he expects it this year, interesting that he had to take out a SBA loan last year if sales have grown 100% every year and he broke even in 2012. I also see he started a new company in April of this year Giru, wonder if that will be the none hunting line.

Yes there is a lot to speculate about. Giru is simply a development platform that allows gear junkies to have input on final versions of new products with the option to purchase at a discount.

Call it a beef, I just find the fan club interesting and having been one of their first customers find it laughable that he believes he operates with honesty and integrity but I guess we all have our own views on what that is. I'm not defending Eastmans, not a big fan of them either.

This will be an interesting case and has the possibility to upturn the publishing industry if Eastmans did pad their circulation counts but also will be interesting to see the fine print on advertising prices and if they even say they are based off circulation. If the price is the price and circulation is just a stat but has no bearing on their price determination it'll be interesting, kind of like Kuiu changing manufacturing from Canada to China and not telling their customers but yet still charging the same price when the customers may of requested a lower price for made in China goods vs Canada.

I mean if you paid $400 for a Yeti and then when delivered it has a stamp of made in China wouldn't you of rather paid a price similar to Atlas at $200?

Hopefully this thread doesn't get deleted and stays civil.

I honestly read EBJ and have a few Kuiu items. Just found the story interesting and is big news in the hunting industry. Not going to side with either company and wait for our judicial system "attempt" to do its job. Figured the adults we are could keep the talk civil.

Regardless of who's right or wrong in this suit, it's just another black eye for us hunters in our small community trying to defend our passion against the much larger non-hunting community. Not good........
