I know from experiences through work...that legit things can go out the back door in China. Once a third or forth party factory has molds/patterns, there's not much stopping them from doing a little extra production under the table and sending it out the back door. Especially if the production run had some unacceptable flaw, etc. or an order quantity was screwed up. Amazon is full of identical products from name brands, some things really just come down to an injection mold, etc.

If something is patent in the US, the patent is only valid in the US. So unless companies patent their design in China as well ahead of production, there is a good chance the product design can be legally duplicated. And if it's sold from China online....bingo.
