I'm probably in the minority here but I think an apartment owner should be able to place pretty much any restriction they want on who lives in their complex. Guy is free to have his guns but have them somewhere else. He talks of losing freedom but the apartment owner is losing his if this decision were reversed.

Move. Private property owner setting up unreasonable rules that create vulnerable targets for criminals. I'm sure the the criminals are chomping at the bit waiting for unarmed people to rob, etc. Sad.

Yep exactly. This is completely ridiculous. Every Burgler and Robber out in Colorado has this place on their list now. Woohoo way to go folks.

BTW, the property owner needs to protect these poor residents now that the residents are going to be unable to legally protect themselves. Probably not going to happen until a lawyer makes them. Can't wait for that to happen. Gun free zones are criminal target zones.

Pretty sad and unjustifiable if you ask me - I would have my crap loaded and be gone before the weeks end. I am guessing anyone who is forced to move over this will likely be considered moving out early and would lose their deposit and any other fees the LL can come up with. Sounds like a company trying to strong arm their residents who's options are limited.

Jmez with the new laws CO passed his friend can not legally store them with out a background check and transfer which is ridiculous.

On another note, in the comments of that story a gentleman who is a licensed firearms dealer in Castlerock offered up free storage and will even cover the background check and transfer fees. Very cool offer and if anyone is local and looking to spend some money at a gun shop I would try to support this guy.

Between these new gun laws, our misguided government and more and more of these types of stories Colorado is becoming less and less desirable for me and my family. Born and raised here but I am quickly becoming ashamed of my state.

I would move if I were the guy. It is like private businesses that reserve the right to not let you carry a gun in their business. I say that is fine I will go somewhere else. Like BUffalo wild wings they have a big sign on the last one I went in, carrying btw and that was the last time I will go there.

Should he be able to kick black people out , Asians ? I think that if you look at the constitution you will not find any exceptions for apartment management . How about if your employer decided that you needed to get rid of your guns to keep your job ? Where do you draw the line ? I personally can't find any exceptions in the second amendment. Every single law on the books regulating how and when you buy , carry , store , ect your arms is unconstitutional imo and every single official who has ever voted for or unpheld any of these regulations has undermined the constitution of the United States of America and is a traitor who should in the least be a convicted felon and many should be put to death for their treason imo.

Definitely sad. I know this is just one apartment owner and not the whole city of Castle Rock but it almost makes me embarrassed to say I'm moving from California to Castle Rock.

You may think that. I MAY agree with you. BUT if we have laws saying you must not deny renting to this race, sex, religion, etc we certainly should not be OK with a landlord being able to not rent to a legal gun owner. Being a landlord can be a tricky business.

Full disclosure on this, I own some apartments.

I tend agree with first reply, however I think that adding this restriction mid-lease is not right.

However, if it's spelled out upfront, then IMO people have a choice to look elsewhere if that don't like the lease restrictions.

I personally do allow guns, but my insurance underwriting keeps getting more restrictive and driving premiums up.

Wouldn't surprise me if this is insurance driven.

Yes, I believe the owner has the right to rent or not to rent to whom he/she/they see fit. Be it blacks, whites, asians, hispanics or gun owners. They own the property I don't believe the state or fed have any right to tell them who their renters can be.

I'm pretty much a straight Libertarian anymore. I believe in freedom to choose, that is not to say I agree with the choice. I'm sure this guy can find a gun friendly place to live.

Doesn't this private policy conflict with Colorados Castle Doctrine and Stand Your Ground laws? I wonder if they have the legal right to make and enforce this policy since it's the renters home and not merely possessing a firearm on someones private property when they post a sign saying "no firearms". Like a movie theater for example. If you disregard the sign, and they find out, then they can ask you to leave, if you refuse, they can press trespassing charges but you haven't necessarily broken any firearms law since it's not against the law to possess the firearm in that place like say a Courthouse.

Bottom line is that none of our opinions matter. What matters is Colorado Law. Renters have rights as well as the property owner. What are those rights in regards to CO firearms law??

Jmez , absolute property rights are not directly written in the US constitution but are implied. The right to bear arms is an actual absolute right under the constitution. Castle doctrine and such are not based in the actual writings of the constitution. " the right to keep and bear arms shall not be infringed upon " versus " unreasonable siezure ". The term towards property is resonable . It's hot and I can barely think at the moment but I cannot recall any amendment stating absolute property rights.

If you take a firearm in you could be prosecuted for trespassing without being asked to leave. By posting the sign they are giving you adequate notice, and disobeying the sign would constitute a trespass.

Dont matter at this point. Everyone should move out of the place cause its not going to be safe from Crime anymore. Look at Chicago. Banned Handguns and now they have the worst murder rate in the country. Why cant these people figure it all out.

My point exactly. Gun free zones are for those who fear or dislike guns (for whatever reason) and those with weapons that disregard the law.

I would argue that anyplace open to the public that attempts to bar those that choose to bear arms is in fact subverting the constitution and is violating civil rights. Any law or interpretation of law that would allow this is imo unconstitutional. An apartment owner is conducting a business and has no property protections under the castle doctrine but ironically creates protected castles for the term of the contract and gives up much control of the property. The interpretation of the second amendment that places the wishes and desires of the state or property owner before the ascribed right to bear arms uninfringed is not based in the constitution. The operating term is resonable for property and the term in our constitution for keeping AND bearing arms is " shall not be infringed upon " . If you disagree then the constitution has a path to voice your displeasure. It is called amending the constitution and how to do that is spelled out. That process does not include ignoring or creative interpretation. All your property rights are at the reasonable discretion of our government and it's courts. It may be hard to swallow but that is the constitutional standard that is spelled out.

Shrek: I would agree that our forefathers had much foresight in their crafting of the Constitution and the Bill of Rights (1st ten Amendments). I'm not real keen on the concept of "majority rule" as I generally would consider the "majority" to be misinformed and easily swayed by something that sounds like a good thing at the time without considering the implications, ex. fallout from the series of school shooting since Columbine. All are tragedies, without question, but more gun laws are not going to make you or the school children more safe. Unfortunately, many are very willing to compromise their constitutional right to bear arms for the perceived sake of safety. I don't have all of the details of this matter or a full understanding of Colorado laws and their impact on the 2nd Amendment, but I would move promptly as I would no longer consider myself in a safe living environment with the gunfree status that will have been advertised to the kooks, spooks and criminals. IMO.

Tstowater , I agree 100%. I believe every legislator who voted for the new laws and all the previous restrictive laws should be tried , convict and sentenced for subversive treason and thier civil rights forfeited. I was seriously thinking of moving to Denver prior to this but it is out of the question now. I'm looking at Idaho now but for local and short haul trucking in the west , Denver looks hard to beat. I'm hoping the current abomination that came out of the Colorado legislature is overturned after the next election and that avenue opens up to me again. Huge amount of business to be done yet within an hour you can be in hundreds of thousands of acres of public land.
