Last minute suppressor vote

Don’t get too excited over this. The $200 tax was never my issue with suppressors/sbr/sbs purchases.

What I’m concerned about is if they do this, it potentially sets a precedent where through the same reconciliation process, a future anti gun administration could effectively reinstate the tax through the reconciliation process and pretty much set it to whatever they wanted adjusted to current rates accounting for inflation.

It needs to be killed outside the reconciliation process, but to get enough feckless Republicans and enough Democrats to overcome the filibuster is an almost impossible task.

Sometimes, you have to take the compromise so you can get the ball rolling.

As a lawyer, I like our odds of defeating the NFA in court if the tax goes away.

The NFA was "legal" because it fell within Congress's power to tax and spend. Without the tax, there is a good chance 5 justices strike down the remaining law as it relates to Suppresors and SBRs.

There is a case regarding suppressors working its way through the 5th circuit now. If this law gets passed before they reach a decision, I wonder if the 5th declares the nfa unconstitutional. It will be interesting to see how they apply Bruen as well.
 
Small win for gun guys, yet some still want to piss in the wheaties. I'll take the W and move forward with more action. I am a glass is half full kind of guy tho.
Could be a big win for the dudes with a pile of suppressors bought as individual that want to move them into a trust. Yeah it'd be nice to not need a trust but for free it'll help.
 
Now that it's back in the house for review, Full NFA removal has been submitted by house rep Andrew Clyde of Georgia. There's still hope!


It still has to go back through the Senate again to approve any changes that the House makes. I applaud the effort, but it is going to take the courts to get them removed. I think the best we can hope for in this bill is to not have to pay the tax, which opens the way for the courts to remove them as they have continually said they cannot do anything with the NFA because it is a tax issue.

Yeah right after this I saw another House Rep is trying to amend it to be $1 instead of 0 so that there is still a tax in place to not be easily removed in the courts later...so the fight continues.

Whether the cost is $1.00 or $0.00, how does that change the fact that, according to congress, it's a taxable item?
Do they specify suppressors are not taxable?
Sure it's nice to save $200 but then that's not the foundational issue.

Sounds like the $0 tax is passing in budget, so lawsuit to possibly remove from NFA if its no longer an income tax to follow.

It passed. Unclear if it goes into effect 90 days (early Oct) or Jan 1 - there is language in the bill along the lines that "goes into effect following the quarter after 90 days", so I'm not sure if that is early Oct or Jan 1. I did hear some of the gun rights groups are pushing for ATF to waive the fee in the meantime, similar to how they did during the amnesty period when they reclassified "pistols" as SBRs.

Regardless, I'm sure demand is about to spike so if you want a can go get it - might be out of stock and also back to longer ATF approval times.
 
The fee never bothered me. The NFA paperwork is my issue. Just make it like a standard firearm and let me purchase OTC. CHL means no wait time

The fee that does bother me is Capitol Armory’s $175 to do the transfer for a dealer out of their network.

If you are in TX why don't you just have them do the paperwork and have it shipped to your house?
