Idaho Poaching Case

I hope you’re right and he gets what he deserves.
Fines won’t hurt him, he pled guilty to a felony(can still archery and muzzleloader hunt), but he needs to lose all his hunting rights for good!
At least he got a felony. County prosecutors can have a lot of cases and I am willing to bet fish and game cases are not their highest priority.

He got a felony with a withheld judgement, that means once he pays his fines and completes his probation the charge will be dismissed and will essentially have never happened

So what do you feel like he deserves? Not keyboard warrior stuff, really - what should the sentence be?

If you would like to let the prosecutor know how you feel, the email is [email protected] Filling that inbox shows how much sportsmen care about poaching.

Felony for each animal, minimum of 10k for each animal, forfeiture of anything involved in the taking (guns, vehicles, etc.) 4k hours traveling statewide to hunters ed classes and explaining to each class how he stole from everyone in the state. Oh yeah, lifetime ban on hunting licenses.

I don't think the money will affect him in any way, but fines in the amount he paid for each tag, maybe the 10K for each tag used that was not his, and then everything @Customweld stated above. especially the lifetime ban and the hunter ed class requirement.

I got in trouble many years ago for shooting at ducks after closing hours, when the judge asked me what I thought a fair punishment was I stated re-taking hunters ed as one of the items. That single thing was the most humiliating thing I've had to do. The instructor knew me and what happened, and had me tell the class why I was there and what I had done.

I think it might hit a little harder if he had to go to every Hunters Ed class and sports shows like the Hunt Expo for 5-10 years and tell his story to all the new people coming into the sport and those he has been bragging to for years. It hits different when you have to admit what you did in front of people.

Not all felonies include a loss of firearms privileges, especially in Idaho. Lots and lots of felons legally own guns

I'm in the water/wastewater industry. A while ago there were a couple of guys that were falsifying turbidity tests in a surface water treatment plant. It was a small system and these guys weren't doing anything malicious, they didn't know how to operate the test components so they just put some numbers down. EPA hammered these guys and made them travel around the state to different training classes and tell everyone what they had done. I can only imagine the shame involved.

Sitting in on the sentencing yesterday I am glad he got what he did! He got the maximum penalties allowed by the charges he received. I don't think the States prosecutor did her job or sportsmen any justice in this case. Lets all be happy with the lifetime ban because for as bad as she stated "our" case in there, I thought he was going to get off completely free.

I do think if we had a prosecutor that knew anything about hunting or wildlife in any way shape or form, and did not have to research what LAP tags or hunting units were prior to this case (that's what she stated in the very beginning of the sentencing) he would have been hit A LOT harder than he did!!! He took the fall on this and all other charges for everyone else involved were dropped......

On a side note, I thought it was a shame that only 6 sportsmen were present.

If he got maximum penalties then it sounds like the prosecutor did her job. Lifetime hunting ban and a felony on top of 180k is pretty harsh.

For him yes, but all other individuals charges were dropped. And i think if she had a knowledge of the sport the others involved would have also got the charges they deserved.

Still curious about Question 14b on Form 4 here. I'm entirely unfamiliar with Idaho laws and associated penalties.

He got a withheld judgment so once he finishes probation and pays fines charges will be dismissed entirely

I didn’t see anything in the article about the withheld judgment as a part of the sentence, it was just in the plea agreement. @huntinfool84 do you remember if the judge gave him a withheld judgment?

The only thing i recall about being withheld was the last 2 years of probation. He got 5 years of unsupervised probation with the last 2 years withheld. That being said the judge did say if he or his attorney did not agree with the sentencing, at the end of his probation they could appeal the charges. Which they will I’m sure.
