If the mount was taller the scope would exert more leverage on the foot and it would induce more shake and probably be more likely to break.
I don't think that Swaro is going to issue a recall to make the scope worse.

The NLs resolve better and are much more comfortable in the hand. There are more positions on an NL eyecup, but they both ultimately twist in/out and are the same size (you can thread an NL Eyecup into an EL)
remove the eyepiece from the spotter tube, if it says ATS 80 instead of ATS 80 HD, you've got your answer about what it is. Colors definitely pop more with an HD optic.
