TLDR:
So, a bunch of Gen Z whingers are suing Ticketmaster for price fixing, monopolizing tickets & giving preference to scalpers & resellers. This all came about because the website crashed a few seconds after the scheduled release time.

Sound familiar?

I had a thought (it's early, I've only had 1 coffee, hear me out)

IF (capital 'if') this is successful, would it set a president that could possibly be used in the future, against game, fish & wildlife departments who do literally the exact same thing, every single year?

They don't allow anyone else to sell them (monopoly)
They tell everyone how much they're paying & give preference to 'their' people (price fixing)
Many give preference to guides & outfitters (scalpers & resellers)

Free market capitalism. I wish I got TS tickets. It would be a 500% return on investment reselling them. people go crazy over that pop crap

This incident will have literally no effect on how wildlife agencies distribute tags.

Alright, a basically very similar thing.

I'm not suggesting it'll automatically change a thing, just pondering on whether it opens the door to possible future suits, based after the same or similar principles.

50 States offer hunting opportunities. You're free to move to any of them. Doesn't sound like a monopoly to me.

I would think that in order for either this or future lawsuits to work they would have to prove that the crash is intentional and is to allow for one group access.

It think that is going to be extremely difficult.

I think the feature of tag distribution schemes most ripe for challenge is outfitter allotments. Carving out a significant portion of a scarce, ostensibly public resource to create guaranteed business for outfitters is blatant welfare for the few at the expense of the many. If outfitters provide value (which most do), hunters will seek out their services voluntarily without the incentive created by outfitter tag allotments.

But I still don't see this Ticketmaster incident having any effect on how tags are managed.

It’s always going to be hard to actually pin blame on the big players when the people responsible for doing so are in bed with them. This goes for most everything in life unfortunately
