Just a question, If i go on a DIY backpack hunting trip for elk, and i take my wife along, but she doesn't carry a firearm and she just goes along and takes pictures etc, do i HAVE to buy an elk tag for her or will just buying a regular hunting license be enough during elk season?

thanks guys, here in virginia and west virginia, she usually does have to have one. they have a little interpretation of the law as "participating in the hunt"

one time while we were bear hunting in virginia, which my neighbor had a license for, and our dogs crossed over into west virginia. myself and my dad done all the walking to get the dogs etc. we had both virginia and west virginia hunting licences so we were good to go. well of course we can't carry our truck on our back, so we had my uncle (who had license inn both states as well) and my neighbor who hunted with us drive around just to pick us up. while we were loading the dogs in my uncles truck, the game warden pulls up and checks our license, he then proceeds to write my neighbor a ticket for not having a hunting license in west virginia. but after a few heated words and an explanation that all he was doing was driving up here to puck us up and hadn't even stepped out of his vehicle he let him off with somewhat of a warning, but required him to BUY his out of state hunting license for west virginia. the game warden stated "he was participating in the hunt"

I made the argument that alot of times I would be on my way home from work (work night shift) and I would stop by and see how my dad and buddies were doing while hunting that day. and I asked the game warden, "so if I stop by and park on the side of the road just to talk to my dad, I am participating in the hunt?" and the game warden said "yes" lol

I've personally called and emailed, california, oregon, Idaho, Washington and Hawaii about this exact issue. All of them said as long as I'm not carrying a Firearm I'm good. They all have something to the effect of hunt participation written somewhere but it comes down to your attempt at harvesting an animal.

Those are bullshit laws IMO. I run into them all the time when hiring camera guys for my out of state hunts. Totally ridiculous. My camera man has yet to kill an animal for me with the camera!

Sounds to me like the guy was just wanting to be a prick. It is something in the water in WV I guess. I grew up there, and law enforcement in general just pisses me off with there attitude. They are so concerned about that type of stupid crap, yet meth heads and pill heads run wild all over the state killing everything that moves and never checking a single thing in.

There was a big discussion about this over on the AOD forum amongst Alaskans regarding their laws. More specifically it had to do with being a backup shooter and so on. However, the question that came up that applies to almost all Non-Res situations is that usually the hunt is a result of some sort of drawing. So, if a buddy wants to tag along with me and be my "sherpa" he has no way of hunting anyway because I drew the tag. So, what is the point of requiring him to purchase a license?
