Interesting how the landowners (some of them are legislators) who supported last years trespassing bill because GPS solves everything, opposed this bill because they are afraid that GPS could be used to prosecute them if they are blocking public access to public land.
“I think it opens the door for myself and many others in rural Idaho to be subjected to civil lawsuits ... some of them legitimate and some just harassment,” said Sen. Bert Brackett, R-Twin Falls.
Brackett said he and other private landowners may have fences that don’t follow property lines to a GPS-specific degree."
Last year they passed the new trespass law based on the "fact" that all sportsman have or should have GPS and don't need landowners to post property boundaries anymore.
Now, they are saying that since some of their own fences might not be in the right place they are worried that if this bill passed, sportsmen with GPS could use it to prove that they are blocking public access.
This bill was meant to help address the issue of large landowners placing gates on public roads that pass through their property. The Wilks Bros have blocked access to thousands of acres by doing this.
