Looks like U.S. District Judge Roger T. Benitez has declared CA's "assault rifle" ban as unconstitutional in Miller v. Bonta.

We'll see what 9th Circuit does next...

Grusum and the rest of the libs will find a way around that, they always do. When the supreme said US citizen do not need to show cause for CCW permit, the Ca. Dems. put very tight restriction on where you are allowed to even carry. If you can even get CCW in the first place. A guy in his thirties would die before his application got approved.

It’s great news, but it won’t last. The libs will just enact another “law” that they know will fail in courts then spend years litigating until they lose. Then they’ll start all over. It’s a never ending cycle

Interesting take
Ive had a ccw here since 2010, took about 8 months back then due to backlog and living in a relatively small county. My wife got hers last year took about 4 months and no justification as we live in a shall issue county.

Agreed the 9th circus will stay this and head up to scotus, just like the magazine ban from a couple weeks ago. I believe the Supreme Court is going to hammer them though, they sent the magazine ban back to the 9th to specifically address bruen which they did not.

So I take it you live in Ca. Based on when you got yours, did you have to show cause? Is that what you meant by justification? I know a Dr. who deals with and transport various drugs, he tried to get a CCW. He got put through the wringer. It took he 9 months to get his. This was about two years ago. As for Benitez, he has made several pro gun rulings that were either put on hold while the 9th circus mulls them over or, were flat out overturned by the 9th circus. I'm certain all his rulings will eventually end up going up to the Supreme Court. Whether they chose to hear them is another thing. As for addressing Bruen, did they not review it or, are they just taking their time?

Yes still in CA.
I’m 2010 I did have to show cause but my cause was carrying cash deposits. My wife had to show no such good cause and was issued on a shall issue basis. Pass a background check and your good to go. The biggest time constraint is finding a course as they’re backed way up.

So the Supreme Court didn’t take up the magazine ban and instead sent it back to 9th so they could apply bruen. They didn’t and instead granted a stay of Saint Benetez order. It will no back to SCOTUS and I have a sneaky suspicion they will take the case since one of their circuit courts failed to follow their directive.
Time consuming but could be a good outcome for other states like CO that have also had restrictions rammed down their throat.

There was a ruling in NY that "protected" gun owners. The Governor just passed a law after the ruling making it illegal to conceal carry almost everywhere. Even when the Supreme Court decides something, the states just blow it off. I think it means nothing for residents of California

I don’t have faith in the government. Even if it gets to the Supreme Court and they support the 2nd the state will just pass another law until it gets litigated away.

Long time CA resident.

The state gov has been politicized by the Dems for decades and their ideology of "No Guns" has permeated not just Governor Newsom's office but every agency and many of the courts.

It's unfortunate that all of the unarmed folks getting robbed and assaulted aren't reported in the MSM. Yesterday a DC congressional aid was robbed....and there are multiple cases every day. What the media doesn't say, is that in a right to carry state like Idaho where carry is a deterrent- these assaults are rare.

The recent ruling will be temporary...kudos to judge Benetiz for his morals and sticking to the constitution.

Hopefully, The rest of you won't soon find out how bad it is when Newsom get swapped in at the last minute as the Dem presidential candidate.

I’m also dubious about how long it will last, but it is always nice to gain legal precedent
