New fridge and temp.

So I got a new convertible fridge freezer because I wanted a stand alone fridge and this one (Insignia 13.8) was the perfect size for my purpose. My concern is that it will only lower food to 39 degrees on the lowest setting. I know this is within the USDA's limit of less than 40 degrees, it's just that I'd like a little bit of a cushion for long term storage items and aging meat.

I'm thinking about taking it back? Thoughts?

I measured this with two different probes, in a cup of water, of several days without opening the fridge.
